1. Who we are
These Terms and Conditions govern your use of the Stackly Coloring website and the purchase of our printable activity packs. Stackly Coloring is a product of Stackly Digital Pty Ltd (ACN 700271585), Suite 17, 89-97 Jones Street, Ultimo NSW 2007, Australia ("we," "us," "our"). By using this website or buying a pack, you agree to these terms.
2. Our products
Stackly Coloring packs are digital downloads (PDF files) designed for printing at home, in a classroom, or elsewhere, for personal or educational use. They are not physical products, and nothing is shipped to you.
3. Buying a pack
Packs are sold through third-party marketplaces (currently Etsy, with Gumroad or Payhip possible in future). Your purchase, payment and delivery are completed on that platform and governed by its own terms and policies, including its refund and dispute process. We set the product content and description; the marketplace handles the transaction.
4. License to use
When you buy a pack, we grant you a personal, non-exclusive, non-transferable license to download, print and use the pack for your own household, classroom or care setting. You may print extra copies for your own children, students or children in your care. You may not resell, redistribute, publish or share the PDF files, or printed copies, with anyone outside your own household or classroom, and you may not claim the pack, its artwork or the Segmented Caterpillar character as your own.
5. Intellectual property
All content on this website and in our packs, including text, illustrations, the Segmented Caterpillar character and design, and the Segmented Caterpillar Approach name, is owned by Stackly Digital Pty Ltd or used under license, and is protected by copyright and other laws. Nothing in these terms transfers that ownership to you.
6. No professional advice
Our packs are created to be fun, engaging early-learning activities. They are informed by general early-childhood development principles, but they are not a substitute for professional educational, developmental or medical advice. If you have concerns about your child's development, please speak with a qualified professional.
7. Availability and changes
We may update, discontinue or change any pack, this website, or these terms at any time. We will try to give notice of material changes where we reasonably can.
8. Liability
To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of this website or our packs. Nothing in these terms excludes, restricts or modifies any consumer guarantee under the Australian Consumer Law, or any other right that cannot lawfully be excluded.
9. Governing law
These terms are governed by the laws of New South Wales, Australia, regardless of where you access this website from.
